The Modern Schoolhouse, LLC (“TMS,” “we,” “us,” or “our”) operates licensed early childhood education centers across California. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information about parents, guardians, prospective families, and — where applicable — the children enrolled in our programs. It also describes the rights you have under applicable law, including the California Consumer Privacy Act (“CCPA”) and the Children’s Online Privacy Protection Act (“COPPA”).
Please read this policy carefully. By using our website (themodernschoolhouse.com), submitting an inquiry or enrollment application, or enrolling your child in any TMS program, you acknowledge that you have read and understood this Privacy Policy.
1. Information We Collect
A. Information You Provide to Us
We collect personal information that parents, guardians, or prospective families provide directly to us, including:
- Contact information: name, home address, email address, and phone number of parents and guardians.
- Child information: child’s full name, date of birth, gender, home address, and program level.
- Health and medical information: immunization records, allergy information, medical conditions, physician contact information, and emergency medical authorization, as required by California Health & Safety Code § 1596.798 and licensing regulations.
- Emergency contacts: names and phone numbers of individuals authorized to pick up your child.
- Financial information: billing and payment information for tuition and fee processing. Payment card data is processed by our third-party payment processor and is not stored on our systems.
- Enrollment data: information provided on enrollment forms, tour requests, waitlist applications, and admission inquiries.
- Communications: messages, emails, or other correspondence you send us.
B. Information We Collect Automatically
When you visit our website, we may collect certain information automatically, including IP address, browser type, operating system, pages visited, and general geographic location derived from IP address. This information is collected using cookies and similar technologies. You may disable cookies in your browser settings; however, some features of the Site may not function properly as a result.
C. Daily Communication App
TMS uses a licensed third-party childcare communication platform to share daily updates, classroom photographs, and messages with families. Information shared through that platform is governed by both this Privacy Policy and the provider’s own privacy policy, which we encourage you to review separately.
2. Children's Privacy — COPPA Notice
Our website is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 directly through our website. Information about enrolled children is collected from their parents or legal guardians solely as necessary to provide our licensed childcare services, maintain health and safety, comply with California licensing requirements, and communicate with families.
We do not use children’s personal information for behavioral advertising or marketing, disclose it to third parties except as described below, or retain it beyond the periods required by law. If you believe we have inadvertently collected a child’s information without parental consent, please contact us at hello@themodernschoolhouse.com and we will promptly delete it.
3. How We Use Your Information
- To provide our services: manage enrollment, maintain licensing records, provide daily care, administer health and safety protocols, and communicate with families.
- To process payments: collect and process tuition and fees.
- To communicate with you: respond to inquiries, send enrollment confirmations, daily updates, school announcements, and program materials.
- To comply with legal obligations: maintain records required under California Health & Safety Code Title 22, fulfill mandated reporting obligations under California Penal Code § 11165.7, and respond to lawful government requests.
- To ensure safety: verify authorized pick-up individuals, manage emergency contacts, and respond to medical situations.
- To improve our services: analyze website and app usage to improve the family experience.
- To market our programs: with your consent, send information about new programs, events, or campuses. You may opt out at any time.
4. How We Share Your Information
We do not sell your personal information. We may share it in the following limited circumstances:
- Service providers: Third-party vendors assisting with operations (payment processing, communication software, cloud storage, IT services, email delivery). These providers are contractually bound to protect your information.
- California Community Care Licensing: We are required by law to make certain records available to the California Department of Social Services upon request.
- Emergency services: In a medical emergency involving your child, we may share necessary information with emergency responders or healthcare providers.
- Mandatory reporting: TMS staff are mandatory reporters under California law and may disclose information to child protective services or law enforcement as required.
- Legal proceedings: We may disclose information pursuant to a valid court order, subpoena, or legal process, or to protect the rights, property, or safety of TMS, our families, or the public.
- Business transfers: In the event of a merger, acquisition, or sale of assets, your information may transfer as part of that transaction. We will provide notice of any such change.
5. Photography and Media
TMS staff may photograph or video-record children during classroom activities and events for daily family communications and developmental documentation. Use of your child’s image in any external marketing material — including our website and social media — requires your separate written consent via the Media Release Authorization provided at enrollment. You may grant or revoke this consent at any time in writing with no effect on your child’s enrollment or care.
If you have communicated a no-media restriction for your child, their image will not be used in any public-facing materials. Please notify your campus director immediately if you believe this has not been followed.
6. California Privacy Rights (CCPA)
California residents have the following rights regarding their personal information:
- Right to Know: Request disclosure of the categories and specific pieces of personal information we have collected about you and how it is used and shared.
- Right to Delete: Request deletion of personal information we hold about you, subject to legal exceptions.
- Right to Correct: Request correction of inaccurate personal information.
- Right to Opt-Out of Sale: We do not sell personal information. If this ever changes, we will provide the right to opt out first.
- Right to Non-Discrimination: We will not deny services, charge different prices, or treat you differently for exercising your CCPA rights.

7. Data Retention
- Enrollment and health records: Retained for a minimum of three (3) years after a child’s last date of attendance, as required by California Community Care Licensing regulations.
- Financial records: Retained for seven (7) years in accordance with applicable tax and accounting requirements.
- Website and marketing data: Retained for no longer than two (2) years from collection.
- Communications: Retained for the duration of your relationship with TMS and up to three (3) years thereafter.
8. Data Security
We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information, including access controls, encryption of data in transit, secure servers, and regular security reviews. No method of electronic transmission is 100% secure. In the event of a data breach affecting your personal information, we will notify you as required by California Civil Code § 1798.82.
9. Third-Party Links
Our website may contain links to third-party sites. This Privacy Policy does not apply to those sites, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.
10. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the effective date above and notify enrolled families by email or through our communication app. Your continued use of our services after such notice constitutes acceptance of the updated policy.
