Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website located at themodernschoolhouse.com (the "Site"), operated by The Modern Schoolhouse, LLC ("TMS," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
These Terms do not constitute or replace the Enrollment Agreement signed by families upon enrollment. In the event of any conflict between these Terms and a signed Enrollment Agreement, the Enrollment Agreement controls with respect to the provision of childcare services.
1. Use of the Site
You may use the Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable federal, state, or local law or regulation.
- Transmit any unsolicited or unauthorized advertising, promotional material, or spam.
- Attempt to gain unauthorized access to any portion of the Site or its related systems.
- Use any automated tool, bot, scraper, or similar mechanism to access or collect data from the Site without our prior written consent.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Engage in any conduct that restricts or inhibits any other person's use or enjoyment of the Site.
We reserve the right to terminate or restrict your access to the Site at any time, without notice, for any reason.
2. Intellectual Property
All content on the Site — including text, photographs, graphics, logos, icons, audio and video clips, digital downloads, and software — is the property of The Modern Schoolhouse, LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
The TMS name, logo, and all related marks are trademarks of The Modern Schoolhouse, LLC. You may not use any TMS trademark, trade name, or trade dress without our prior written permission.
You may view, download, and print content from the Site solely for your personal, non-commercial use, provided that you do not modify the content and that you retain all copyright and proprietary notices.
3. Tour Requests and Admissions Inquiries
Submitting a tour request, waitlist application, or admissions inquiry through the Site does not constitute a binding enrollment or guarantee of placement in any TMS program. All enrollments are subject to availability, eligibility requirements, and execution of a separate Enrollment Agreement. TMS reserves the right to accept or decline any application in its sole discretion, provided such decisions are made without regard to characteristics protected under applicable law.
4. Enrollment and Program Services
The following terms apply to families enrolled in TMS programs. Full details are set forth in the Enrollment Agreement provided at the time of enrollment.
A. Tuition and Fees
Tuition and applicable fees are set forth in the fee schedule provided during the enrollment process and are subject to change with reasonable advance notice. Tuition is due on a monthly basis as specified in the Enrollment Agreement. Late payments may be subject to a late fee. TMS does not provide tuition refunds for absences, closures due to state-mandated holidays, staff development days, or circumstances beyond TMS's reasonable control, including public health emergencies.
B. Withdrawal Policy
Families wishing to withdraw a child from any TMS program must provide written notice to the campus director no fewer than 60 days prior to the intended last date of attendance. Failure to provide adequate notice may result in forfeiture of any enrollment deposit and liability for up to 60 days of tuition charges.
C. Program Hours and Closures
TMS programs operate Monday through Friday, 7:30 a.m. to 5:30 p.m., excluding state-mandated holidays, winter break (approximately two weeks), summer break (approximately two weeks), and up to six (6) professional development days per year. Families receive an academic calendar upon enrollment. TMS reserves the right to close campuses in response to emergencies, public health orders, or other circumstances that affect the safety of children and staff.
D. Health and Immunization Requirements
All children enrolled in TMS programs must comply with California's immunization requirements under Health & Safety Code § 120325 et seq. Up-to-date immunization records must be provided prior to a child's first day of attendance and updated as required throughout enrollment. TMS does not accept personal belief exemptions for vaccines required under California law. Children who fail to meet immunization requirements may be excluded from attendance until compliance is achieved.
E. Illness and Sick Policy
To protect the health of all children and staff, children who are ill may not attend TMS programs. A child must be free of fever (below 100°F without the use of fever-reducing medication), vomiting, diarrhea, or other contagious symptoms for a minimum of 24 hours before returning to care. TMS does not administer medication of any kind. If a child becomes ill during the school day, the parent or guardian will be contacted immediately and is required to arrange pick-up within a reasonable time. In the event of a contagious illness diagnosis, TMS may require a physician's clearance prior to the child's return.
F. Child Safety and Mandated Reporting
All TMS staff members are mandated reporters under California Penal Code § 11165.7. TMS staff are required by law to report any known or reasonably suspected child abuse or neglect to the appropriate authorities. Fulfillment of this legal obligation does not constitute a breach of any duty of confidentiality owed to families.
G. Authorized Pick-Up and Release of Children
Children will be released only to individuals listed as authorized pick-up persons on the enrollment forms, or to individuals whose authorization has been communicated to TMS in advance in writing. TMS reserves the right to request photo identification from any individual seeking to pick up a child. In the event of a custody dispute or court order restricting parental access, TMS requires a copy of the applicable court order before it can restrict a parent's access to a child.
5. Photography, Video, and Media Release
TMS may photograph or video-record children during the normal course of school activities for the purpose of family communications through our daily communication app and for internal documentation of developmental progress. Such use does not require a separate written release.
Use of a child's image or likeness in any external marketing materials — including the TMS website, social media accounts, printed materials, or advertisements — requires the prior written consent of the child's parent or legal guardian, as set forth in the Media Release Authorization provided at enrollment. Consent for marketing use is entirely voluntary and may be withdrawn at any time by written notice to the campus director.
Families who have communicated a no-media restriction for their child should ensure that restriction is documented in writing with the campus director. TMS takes these requests seriously and maintains internal records to ensure compliance.
6. Code of Conduct
TMS is committed to maintaining a safe, respectful, and inclusive environment for all children, families, and staff. TMS expects all members of its community — including parents, guardians, and authorized pick-up individuals — to interact with staff and other families in a manner that is courteous, respectful, and consistent with our community values.
TMS reserves the right to terminate enrollment or restrict access to its premises for any family whose conduct is deemed by TMS, in its reasonable discretion, to be threatening, harassing, abusive, or otherwise incompatible with a safe and respectful school environment.
7. Disclaimer of Warranties
THE SITE AND ALL CONTENT, MATERIALS, AND INFORMATION AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TMS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE MODERN SCHOOLHOUSE, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF TMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL TMS'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
Nothing in these Terms limits TMS's liability for gross negligence, willful misconduct, fraud, or any liability that cannot be excluded or limited under applicable law, including liability for personal injury to a child in our care.
9. Indemnification
You agree to indemnify, defend, and hold harmless The Modern Schoolhouse, LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) your infringement of any third-party right.
10. Third-Party Links
The Site may contain links to third-party websites or resources. TMS provides these links for convenience only and does not endorse, and is not responsible for, the content, privacy practices, or terms of any third-party sites. Your use of third-party sites is at your own risk and governed by the terms of those sites.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising out of or related to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.
For disputes related to enrolled services, TMS encourages families to first attempt informal resolution by contacting the campus director or our administrative team at hello@themodernschoolhouse.com. Many concerns can be resolved quickly and amicably at this stage.
12. Changes to These Terms
We may revise these Terms at any time. When we make material changes, we will update the effective date above and, where appropriate, notify enrolled families by email. Your continued use of the Site after any changes become effective constitutes your acceptance of the revised Terms.
